American Maid-Illinois, LLC Terms and Conditions

AMERICAN MAID – ILLINOIS, LCC TERMS and CONDITIONS

GENERAL TERMS AND CONDITIONS as used in this contract, “we”, “our”, and “us” means AMERICAN MAID-ILLINOIS, LLC; “you”, “client”, and “customer” means the person identified on this quote. This document is a legally enforceable contract. By signing this contract, you agree that you are the party responsible for the property identified on this quote and authorize us to perform the work and you agree as follows: 


PAYMENT: 

· We do not accept checks.

· You agree to payment in full immediately upon completion of the job. 

· You agree that after midnight on the day of service/job completion a $25.00 late fee will be added to your account.

· An additional late penalty will be added to the invoice on a monthly basis equal to 10% of the outstanding invoice.

· Invoices outstanding more than 180 days can result in collections and/or legal action and all associated collection fees will be added to your invoice.


CANCELLATIONS / LOCKOUT / ACCESS: Service reliability is extremely important. We will often turn down business rather than disrupt a regularly scheduled customer. In exchange we must request that you give us a minimum of 48 hours advance notice (Monday clients must call before noon on the previous Friday). Cancellations with less than 48 business hours’ notice (Mon – Fri 9am to 4pm) except those cancellations caused by extreme weather events of our scheduled arrival date/time will be subject to the full contract/visit price as we are not given enough time to reschedule your technician elsewhere. Lockout or the inability to gain access within 15 minutes of our scheduled time to the area where the work is to be performed will result in a charge equal to the full contract/visit price for our lost time. Frequent cancellations for any reason can result in the cancellation of our service agreement. 


RECURRING SERVICE DISCOUNT LOSS: Recurring cleaning services are discounted based on the frequency of the service you select. The more frequently you have us clean your home the higher the discount. At the onset of our cleaning partnership, our technicians often invest additional time and effort to bring your home up to our high standards. This initial investment is made in consideration of the long-term commitment you have made. Please be aware that cancelling your service after the first visit will result in a 75% increase in cost. Similarly, cancelling after the second service will incur a 50% increase, and after the third service, a 25% increase will apply. However, cancelling after the fourth service will not result in any additional charges.

LIABILITIES and LIMITATIONS: American Maid is a professional cleaning service that is fully insured. We take great care in training our staff in proper techniques and use so that they can take great care when working in or on your property, but accidents can happen. Our staff is trained to notify management immediately when damage occurs. We do have some limitations in terms of our liability. These include: 

· Items of value that are non-replaceable, one-of-a-kind, sentimental value, collector items, discontinued patterns, family heirlooms, and high-cost items of any kind are required to be disclosed to and acknowledged by American Maid - Illinois in writing prior to our first visit to your property. Once you notify us of such items, we will list them in detail on a document along with how these items will be handled and this document will be agreed upon and signed by both the property owner and owner of American Maid – Illinois. We will not be liable in any way for these types of items that are not disclosed in writing.  

· All surfaces that are recommended to be sealed including but not limited to wood, marble, quartz, granite, concrete, grout, ceramic etc. are assumed sealed and ready to clean without causing harm. We will not be liable for items damaged due to improper sealing.

· We are not liable for damage to TVs, monitors, or screens of any kind. We do not clean these items.

· We will not be liable for damage caused by missing, worn or damaged grout, caulking or sealants.

· We are not liable for broken or damaged due to product wear-and-tear, nor damage to or caused by fixtures that are not properly secured such as pictures, mirrors, window treatments, wall coverings, lack of furniture glides for wood floors, lack of scratch covers on the bottom of furniture decor, cabinet mounted appliances, and household accessories.

· We will not be liable to damage or malfunction to client supplied equipment, tools and supplies including all styles of vacuum.  

· We will not accept liability for damages directly or indirectly caused by client supplied materials, equipment, chemicals, etc. 

· We will not be liable for damage that is not reported within 24-hours of us servicing your property. 

· When a damage claim is made a repairman of our choosing must be given access within 24-hours of your claim to assess the claim.  

· When it is agreed we are liable a repairman of our choosing must be allowed to repair what is broken or damaged if a repair is warranted. In the event a repair is not possible we will be liable for the replacement cost of the item(s) up to the amount of your cleaning service fee on the day the damage occurred.  If an item is part of a set, only the cost of the individual item will be considered and not the entire set. 

American Maid-Illinois takes responsibility for breakage or damage caused by our staff. In the event we need to file a claim with our insurance company we will notify them of your information and an adjuster from the insurance company will be in touch to resolve the problem.   


DAMAGE CLAIM PROCEDURE: Our damage policy must strictly follow this procedure:

Report the Damage: All damage must be reported within 24 hours of completion of service by American Maid - Illinois.

Access for Assessment: When a damage claim is made, a representative on behalf of American Maid - Illinois must be granted access within 24 hours of your claim to assess the damage.

Repair Agreement: If American Maid - Illinois would like a professional opinion regarding the damage and/or if it is determined or agreed upon that American Maid - Illinois is liable for the damage, a repairman of American Maid - Illinois’ choosing must be allowed to repair the damaged.

Access Requirement: If you are unable or unwilling to grant a repairman of American Maid - Illinois’ choosing access to inspect and/or conduct the repair, you forfeit your right to any claim.

Replacement Liability: In the event American Maid - Illinois and/or their repairman determines a repair is not possible, American Maid - Illinois will be liable for the cost of damages up to the amount of your cleaning service fee on the day the damage occurred. If the item is part of a set, only the cost of the individual damaged item will be considered, not the entire set.

Repair and Resolution Protocol: Should our repair personnel be unable to rectify the damage, and upon mutual agreement between American Maid-Illinois and the client to accept full responsibility, American Maid-Illinois will either bear the full cost of repair or, if necessary, initiate an insurance claim process. In the latter scenario, the client's information will be communicated to our insurance provider, facilitating direct contact between the client and the insurance adjuster for prompt resolution.


CLIMATE CONTROL: With today’s technology it is easy to program a thermostat for away mode. Our technicians nor their chemicals work very well in very cold or very hot temperatures. We will never adjust the temperature in your home. Keep in mind, even if you request us to do so it is near impossible for your home to cool or heat to the appropriate temperature within the timeframe needed. We ask that you keep the house at a comfortable temperature (between 68° and 75°) during the time of your service. If the property is too hot or cold, we will have to leave the job unfinished and result in a charge equal to the full contract/visit price for our lost time.


PETS: It is preferred that pets be crated or placed in a secure location. We recognize that this is not always possible and will do our best to work in harmony with your pet, but if the technician at any time feels uncomfortable, we reserve the right to cancel service for day and result in a charge equal to the full contract/visit price for our lost time. 


QUOTES: All quotes are subject to change upon site/job inspection. You will be informed if a change is required and requoted accordingly for your approval prior to work commencement. Cleaning quotes are valid for 30 days we reserve the right to requote and/or cancel an approved quote.


EMPLOYEES: We invest time, money, energy, and training in our employees. Because they are excellent at what they do, they could be solicited by clients to work for the client personally. The client understands and agrees to pay damages of $3,500 fee should the client hire any of American Maid-Illinois employees while they are employed by the company or within three years following the employee’s last day as an employee of American Maid-Illinois.


ACTS OF GOD: We are not liable for delays caused by adverse weather, acts of God, or any circumstances out of our control. 


OWNERSHIP / LEGAL RIGHT: You warrant that you are the owner or are entitled to legal possession of the job site and that you have the power and authority to enter into this contract and to authorize us to perform the work. If your spouse/partner is an owner of the job site, then you also represent that you are authorized to enter into this contract on behalf of your spouse/partner and agree, for yourself and for your spouse/partner, that you and your spouse/partner are jointly and severally liable under this contract. If the jobsite is owned by an organization, then the person signing this contract represents that he/she is authorized to enter into this contract on behalf of the organization. You agree that if you misrepresent your ownership or legal right you are personally liable to the full extent of this contract. 


ASSIGNMENT: This contract is binding upon and inures to the benefit of each party and its respective legal representatives, successors, heirs, and assigns. Neither you nor we may assign our rights or obligations under this contract, including any warranties made by us, without the other party’s prior written consent. If any provision of this contract is held to be illegal, invalid, or unenforceable, that provision will be deemed to be modified to the extent necessary to permit its enforcement to the maximum extent permitted by applicable law, and the remaining provisions of this contract will not be affected. 


LIMITED WARRANTY: We warrant that all labor we provide in connection with cleaning services is free from defect for a period of 24 hours after completion. Should a defect in quality be discovered within the 24-hour period you agree to schedule a time for a technician to gain access to your property to remedy the issue of quality. Should you not provide opportunity and access you agree to give up claim to remedy, refund or any further action. This limited warranty is void if you do not pay all charges for the job immediately upon completion. We do not warrant any work completed using client supplied equipment, tools, chemicals, or other goods, provided by you to us. 


CHANGE ORDERS: If you fail to request and sign a quote for additional or changed work requested by you, you will still be liable for the full cost of the work. All additional work and changes in writing or not will become a part of this job and subject to these terms and conditions. 


READY TO CLEAN: You recognize that timeliness is important, and it is imperative our cleaning technicians stay on schedule and on task. When they arrive to clean your home there is a systematic approach to cleaning that allows for nothing to be missed as well as the most effective use of time. When this routine changes so does quality and timeliness. Therefore, you agree that during your scheduled cleaning time you will not shower, bathe, cook or otherwise delay the cleaning process. The technicians will start in the master bath and if two cleaners the 2ndin the kitchen. Please remember a hot stove is an exceedingly difficult stove to clean. 


VACUUM, MOP, OR OTHER TOOLS SUPPLIED BY CUSTOMER: Client agrees to supply a vacuum in good working order and understands that we can only vacuum as well as the machine will allow in one overlapping pass. We will take every precaution necessary to keep the equipment in good working order, but we are not responsible for breakdown or damage done to any tool or implement used in the proper manner for which it was intended. We are not held liable for replacement, repairs, or maintenance of our client’s equipment. We cannot wait for a vacuum to charge. If you supply a battery-operated vacuum, we will vacuum as long as the battery lasts.


CHANGES IN CLEANING ENVIRONMENT: We realize life happens and things change. We are happy to, when we can, work with you and through occasional or short-term changes, but please understand that certain circumstances will result in a longer cleaning time and in turn will result in revisiting our cleaning parameters and/or charges with you. An example of some of the things that can result in an increased charge (discussed with you prior to increase) are: getting a new or additional pet, additional people living in the home, changing from carpet flooring to hard flooring, addition of a large amount of furniture, knickknacks or décor items, excessive recurring soil level in spite of routine cleaning, the use of glitter, confetti, certain bath salts, oils or dyes. 

  

EXCLUDED FROM CLEANING: For the health and safety of our team please understand that we cannot clean areas that contain any biohazardous, pet mess, infestation, mold or suspected mold. Biohazardous material such as, but not limited to feminine hygiene products, baby diapers, wipes or soiled clothing, bodily fluids such as urine, feces, or blood. Pet messes that include, but are not limited to urine, feces, vomit, saliva, torn up garbage or destruction of any item. Infestation of bed bugs, roaches, lice, fleas, rats or mice. Mold or suspected mold. 


AGREEMENT: This contract shall be governed by the State of Illinois. By signing a quote digitally with American Maid-Illinois you agree that you have read, understand, and agree to the entirety of this contract. of value that are non-replaceable, one-of-a-kind, sentimental value, collector items, discontinued patterns, family heirlooms, and high-cost items of any kind are required to be disclosed to and acknowledged by American Maid - Illinois in writing prior to our first visit to your property.
